These Terms and Conditions ("Terms") govern your use of GPX Fixer (the "App"), provided by Fins Out Media ("we," "us," or "our").
By downloading, accessing, purchasing, or using GPX Fixer, you agree to these Terms. If you do not agree to these Terms, do not use the App.
Important: GPX Fixer is a file editing and conversion utility. Repairs, previews, statistics, and exports should be reviewed before relying on them for navigation, safety, event planning, travel, or professional use.
1. Purpose of GPX Fixer
GPX Fixer is designed to help users open, preview, edit, repair, simplify, trim, reverse, merge, convert, and export GPX files.
The App is provided as a convenience and productivity tool. It is not a navigation app, route recording app, emergency tool, surveying instrument, or substitute for professional mapping, trip planning, safety, engineering, or other professional advice.
2. File Repair and Export Accuracy
GPX Fixer is designed to find and safely fix common GPX structural problems. It does not guarantee that every GPX issue can be detected or repaired.
GPX files can vary widely by source, device, app, formatting, data quality, and file completeness. Edits, conversions, statistics, map previews, and exports may be affected by:
- Incomplete, corrupted, unusual, or invalid source files
- Missing or inconsistent track, route, waypoint, time, or elevation data
- Rounding, simplification, trimming, merging, or conversion choices
- Differences between GPX, KML, CSV, and other apps or devices
- Map display limitations or differences between map providers
You are responsible for reviewing source files, previews, selected edits, exported files, and any downstream use of those files.
3. No Navigation or Safety Advice
GPX Fixer does not provide turn-by-turn navigation, live tracking, emergency services, route safety validation, trail condition information, legal access information, or hazard warnings.
Always use appropriate judgment, maps, local conditions, official guidance, and safety practices before using any route for hiking, cycling, running, driving, travel, or outdoor activity.
4. User Responsibility
You are solely responsible for:
- Choosing which files to open, edit, export, or share
- Keeping backups of important GPX files and related data
- Reviewing changes before exporting or relying on edited files
- Determining whether exported files are suitable for your app, device, or use case
- Complying with applicable laws, trail rules, land access rules, and safety requirements
- Decisions made based on files, previews, statistics, or exports from GPX Fixer
5. GPX Fixer Premium
GPX Fixer may offer optional Premium functionality through a one-time non-consumable in-app purchase.
Premium may include unlimited edits and exports, GPX export, KML or CSV conversion, merge tools, and related functionality. Available features may evolve as the App is updated.
Purchases made through the Apple App Store are processed by Apple and are also subject to Apple's applicable terms, policies, and refund procedures.
6. Local Files and Data Loss
GPX Fixer works with files on your device or files you choose to open from available file locations.
You are responsible for maintaining your device, files, backups, and any exported copies you consider necessary. Fins Out Media is not responsible for loss of locally stored files, exports, edited versions, source files, or other information resulting from device loss, device failure, deletion of the App, software updates, data corruption, file-provider behavior, or other circumstances.
7. Exports and Shared Information
Exports generated by GPX Fixer are provided for convenience and informational purposes. Their use in another app, device, file, report, or workflow does not guarantee compatibility, accuracy, suitability, or safety.
You are responsible for reviewing exported or shared information before relying on, distributing, uploading, or sharing it.
8. Acceptable Use
You agree not to:
- Use GPX Fixer for unlawful purposes
- Attempt to interfere with the operation or security of the App
- Reverse engineer the App except where applicable law expressly permits it
- Copy, redistribute, or commercially exploit the App except as permitted by law
- Misrepresent Fins Out Media as certifying, validating, or approving a route, trip, event, file, or export
9. Intellectual Property
GPX Fixer, including its software, design, branding, graphics, interface, content, and related intellectual property, is owned by or licensed to Fins Out Media and is protected by applicable intellectual property laws.
These Terms do not transfer ownership of GPX Fixer or its intellectual property to you.
10. Availability and Changes
We may update, modify, improve, suspend, or discontinue portions of GPX Fixer at any time. We do not guarantee that the App or every feature will always be available or error-free.
11. Disclaimer of Warranties
To the maximum extent permitted by applicable law, GPX Fixer is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
Fins Out Media does not warrant that file repairs, previews, statistics, edits, conversions, or exports will be error-free, complete, compatible with every app or device, or suitable for a particular route, trip, event, or use.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Fins Out Media and its owners, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of GPX Fixer.
This includes, without limitation, losses or costs associated with inaccurate or incompatible files, route decisions, travel decisions, event planning, safety issues, lost data, lost files, property damage, personal injury, lost profits, or reliance on a file, preview, statistic, edit, conversion, or export generated by the App.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
13. Apple App Store
If you download GPX Fixer through Apple's App Store, you acknowledge that these Terms are between you and Fins Out Media, not Apple, and that Fins Out Media is responsible for the App subject to these Terms.
Your use of GPX Fixer must also comply with applicable App Store terms and policies.
14. Changes to These Terms
We may update these Terms as GPX Fixer changes. When we do, we will update the "Last updated" date shown above.
